The articles of association of a housing cooperative regulate the association’s operations and ensure that all members follow the same rules and guidelines.
As a member, you have entered into a legally binding agreement with the association to comply with its articles. It is therefore important to read them carefully upon joining the cooperative and to familiarise yourself with their content. Failure to comply with the articles can, in the worst case, result in the loss of your flat, liability for damages, or legal proceedings.
As the articles are shared rules, they can only be amended through a vote by the members at a general meeting. Two separate meetings are required to adopt any changes. Members may submit proposals (motions) for amendments to be considered at the Annual General Meeting. However, you must be able to provide well-reasoned arguments in support of your proposal.Swedish law takes precedence over the articles, which means any proposed changes must comply with current legislation.
